Grenshopper Terms and Conditions
This translation is provided for convenience. If the two versions differ in their interpretation, the Dutch version prevails.
1. Definitions
In these terms and conditions, the following words mean:
- Grenshopper: the mobile application and related services offered by Grenshopper B.V.
- User: any natural person who downloads and/or uses the app
- Account: the personal environment a user creates within the app
- Service: all functionality Grenshopper offers, including comparing fuel prices across several countries, calculating savings and detour time, navigation with traffic information, notifications, paying at the pump at participating filling stations and Free fuel
- Pro membership: the membership with access to all features of the app, which you receive free of charge when you create an account (see article 5)
- Fuel receipt: the overview of a fill-up in the app, including the filling station, the fuel, the number of litres, the price and the calculated saving
- Test phase: the period in which Grenshopper makes a version of the app that is not yet final available to a limited group of users (see article 13)
2. Scope
2.1 These terms and conditions apply to every use of the Grenshopper app and to all services we offer.
2.2 By downloading and/or using the app, you agree to these terms and conditions and the accompanying privacy policy (grenshopper.nl/privacybeleid).
2.3 Grenshopper B.V. may change these terms. We will inform you of significant changes in advance, in the app or by email. If you continue to use the app afterwards, the changed terms apply.
3. Using the app
3.1 Grenshopper is meant for personal, non-commercial use.
3.2 You must be at least 16 years old to use the app.
3.3 You may not:
- Use the app for unlawful purposes
- Reverse engineer, copy or modify the app, except where the law expressly allows it
- Send automated requests to our servers, or automatically read out or collect data from the app or our servers (scraping)
- Circumvent security measures, or test the security of the app or our servers without our prior written permission
- Create multiple accounts to get around limits or promotions
- Interfere with other people using the app
3.4 Grenshopper B.V. may block or delete accounts in case of misuse or a breach of these terms.
3.5 Staying safe on the road
3.5.1 On the road, only use the app in a holder and do not operate it while driving. Set your destination before you leave, or let a passenger do it.
3.5.2 Traffic rules, road signs and instructions from authorised persons always take precedence over directions in the app. You remain responsible for your own driving and your route.
4. Account
4.1 Some features require an account. You are responsible for keeping your login details to yourself.
4.2 You are responsible for everything that happens under your account.
4.3 You can delete your account at any time in the app settings. When you do, your data is handled in line with our privacy policy.
4.4 You can set up a maximum of three vehicles per account.
5. Pro membership
5.1 When you create an account, you automatically become a Pro member. Pro membership is currently free and gives access to all features of the app.
5.2 Grenshopper B.V. plans to offer Pro membership as a paid service in the future. If it does, we will inform you well in advance, in the app and by email, including the price and the terms.
5.3 We will never charge you without your explicit consent. A paid membership only starts if you actively choose it yourself.
5.4 Payments for fuel at the pump are separate from the membership. Article 12 applies to those.
6. Collecting and processing data
6.1 By using Grenshopper you agree to the collection and processing of data as described in our privacy policy. This includes:
- Location data (with your permission)
- Account and profile data, such as your name and email address
- Vehicle data, such as number plate, fuel, tank size and consumption
- Saved places and favourite stations
- Fuel receipts and, if you pay at the pump, transaction data
- Feedback you send, possibly with a screenshot
- Device and usage data
6.2 Grenshopper B.V. uses collected data in aggregated and anonymised form for internal analysis and to improve the product. Individual data is never shared with third parties for commercial purposes.
6.3 You can ask to see your data at any time, and have it corrected or deleted, in line with our privacy policy and the General Data Protection Regulation (GDPR).
7. Accuracy of information
7.1 Grenshopper aims to show up-to-date and correct fuel prices and station information. However, we cannot guarantee that this information is always accurate.
7.2 The calculations in the app are indicative. Actual savings can differ, among other things because of:
- Fluctuations in fuel prices
- Exchange rate changes
- Individual driving style and consumption
- Traffic and conditions on the road
- Current offers at filling stations
7.3 Grenshopper is not liable for decisions you make on the basis of the information in the app.
7.4 Routes, travel times, traffic information (such as traffic jams, closures and roadworks) and speed limits in the app are based on third-party sources, such as OpenStreetMap and the Dutch National Road Traffic Data Portal (NDW). They are indicative and may differ from the situation on the road.
8. Availability
8.1 We aim for the app to be available 99% of the time, but cannot guarantee it.
8.2 We reserve the right to take the app offline temporarily or permanently for maintenance or updates.
8.3 We are not liable for damage caused by the app being temporarily unavailable.
9. Intellectual property
9.1 All rights to the app, including software, design, logos and content, belong to Grenshopper B.V.
9.2 Content from the app may not be copied, distributed or published without written permission.
9.3 Aggregated and anonymised insights that come out of the use of the app are the property of Grenshopper B.V.
9.4 The collection of price and station data as compiled and presented by Grenshopper is protected, among other things by database rights. You may only consult this data through normal use of the app. Retrieving, copying or reusing (parts of) this data in any other way is not permitted.
10. Anonymised data
By using Grenshopper you agree that Grenshopper B.V. may use, analyse and make available to third parties anonymised and aggregated data that cannot be traced back to you as a person. This may be for statistical analysis, market research or government purposes, among other things. For more information, see our Privacy Policy (grenshopper.nl/privacybeleid).
11. Liability
11.1 Grenshopper B.V. is not liable for indirect damage, consequential loss or lost profit.
11.2 The total liability of Grenshopper B.V. is in all cases limited to the amount you paid to Grenshopper in the twelve months before the event that caused the damage or, if that is higher, to one hundred euros (€100).
11.3 Grenshopper B.V. is not responsible for the content of external websites or services the app links to.
11.4 Grenshopper B.V. is not liable for damage resulting from the loss, inaccuracy or incompleteness of data you enter yourself, such as vehicle data, fuel receipts and saved places.
11.5 Grenshopper B.V. is not liable for damage that arises because you follow a route, direction, speed limit or traffic information from the app that differs from the situation on the road, or because you use the app on the road in breach of article 3.5.
11.6 The limitations in this article and in article 13 do not apply if the damage results from intent or deliberate recklessness on the part of Grenshopper B.V. or its management, nor to the extent that mandatory law does not allow a limitation.
12. Paying in the app
This article is a draft. It has not been reviewed by a lawyer yet. No rights can be derived from this text for now; the rest of these terms apply in full.
12.1 At participating fuel stations you can pay at the pump from the app. To do so you set up a payment method once. There are two options: direct debit through a SEPA mandate, or a credit card.
12.2 You buy the fuel from the fuel station and you pay the fuel station. The station is the collecting party: the amount goes directly from you to the station, and Grenshopper is not part of the money flow. We are not a party to the purchase and do not sell fuel ourselves. The app and the payment service behind it only make sure the payment goes through.
12.3 The SEPA mandate
12.3.1 If you choose direct debit, you sign a SEPA mandate once. You do this by transferring 2 cents through your own bank, or by entering your IBAN directly. Those 2 cents are not a payment for a service but a verification: with that transfer your bank establishes that the account is yours, and the mandate is legally signed.
12.3.2 With the mandate you allow the fuel station to debit the amount of a fill-up from your account. The direct debit is carried out by the station or on its behalf, and not by Grenshopper. Your bank statement therefore shows the station and not us.
12.3.3 If you disagree with a debit, with a SEPA direct debit you can have your bank reverse it up to 8 weeks after the debit date without giving a reason. For an unauthorised direct debit the period is 13 months. That right is with your bank and it stands separately from a complaint with us.
12.3.4 You can withdraw your mandate or change your payment method at any time in your profile in the app. A withdrawal applies to future fill-ups and not retroactively.
12.4 Paying by credit card
12.4.1 If you choose a credit card, an amount is held on your card in favour of the fuel station when the pump is unlocked. That hold is not a charge: the amount is temporarily unavailable to you and the actual charge follows after the fill-up.
12.4.2 You only pay for what you actually put in. The difference between the hold and the final amount is released; how quickly that shows on your statement is up to your card issuer.
12.4.3 If the fill-up does not go ahead, no charge is made and the hold lapses.
12.5 Receipts and incorrect amounts
12.5.1 After every fill-up you will find a receipt in the app with the litres, the price per litre and the total amount.
12.5.2 If an amount is wrong, report it as soon as possible through hello@grenshopper.nl. Because you pay the fuel station, a correction or refund runs through the station; we mediate in that. The amount is determined by the pump and not by Grenshopper.
13. Test phase
13.1 Grenshopper may first make a new version of the app available as a test version to a limited group of users, for example through Apple TestFlight or a closed test in Google Play. Participation is voluntary and by invitation.
13.2 A test version is still in development. Features may be missing, contain errors, work differently than intended, or change or disappear during the test phase. A test version is provided as is, without any guarantee of accuracy, completeness or availability.
13.3 During the test phase, the app works with a separate test environment. Your account and the data in that environment may be deleted during or at the end of the test phase. Where possible, we will let you know in advance. So do not store anything in the test version that you do not want to lose.
13.4 Prices, savings, routes and traffic information in a test version may be incomplete or incorrect. Always check important information, such as the price at the pump, yourself on site.
13.5 Paying at the pump may be switched off during the test phase. If it is switched on, article 12 applies.
13.6 We may use what you send us as feedback, such as text, screenshots and ideas, to improve the app, without you receiving any payment for it. Do not include sensitive personal data in your feedback. How we handle feedback and screenshots is described in the privacy policy (grenshopper.nl/privacybeleid).
13.7 During the test phase, Grenshopper may have the security of the app and the test environment examined by a specialised party. That party works under confidentiality and in line with our data protection agreements.
13.8 If you take part in Free fuel during the test phase, the terms and game rules of Free fuel on our website (grenshopper.nl) also apply.
13.9 To the extent permitted by law, Grenshopper B.V. is not liable for damage resulting from the use of a test version, including damage caused by errors, unavailability or the deletion of data in the test environment. Article 11.6 continues to apply.
13.10 Grenshopper may end the test phase or your participation at any time. You can stop at any time by removing the test version from your device. You can delete your account in the app settings.
14. Governing law and disputes
14.1 Dutch law applies to these terms and conditions.
14.2 We prefer to settle disputes by talking them through. If that does not work, the competent court in the Netherlands decides. If you are a consumer living in another EU country, you keep the protection that the mandatory law of that country gives you, and you can also go to the court where you live.
